Typosquatting, clickjacking, likejacking, or using hacked sites;

Any association with stolen, libellous, or discriminatory content, or illegal activity;

Anything which is misleading, including creating a false sense of urgency

Social media advertising where new users lose sight of the cost of the service;

Interfering with presentation of the price of the service or implying the service is free;

Any viruses, malware, spyware, or other malicious or harmful code.

Association with violent material;

Promotions particularly attractive to children;

Promotions to a vulnerable group;

Social media advertising;

Voucher and incentives schemes including instant wins;

Toolbars, adware, and malware.

[19/09/2016 12:29:19] Katie Brzost: Undue Sense of Urgency – Creating a false sense of urgency to hurry a customer into entering a PRS service is likely to be deemed misleading. Statements such as “Please respond NOW before other visitors from London have a chance to win the prize” have been used as a reason to uphold breaches in the past. Another example of what is considered to induce undue urgency is the use of Countdown Clocks. Also pre landers should not claim prizes are “unavailable” as this creates and undue sense of urgency.

Instant Win – advertising that misleads customers to believe they have already won or are a guaranteed winner of a prize. In the case of competition services all calls to action should be conditional (e.g. you could win). You should not permit statements such as ‘you have won’. AIME recommends also the use of “purchase necessary” statement in the advertising to avoid consumer confusion.

Inaccurate Prize Dates – consumers should not be misled into thinking that prize draws will occur more frequently than the terms detailed in the terms and conditions within the PRS promotion.

Inaccurate Prize Quantity References – consumers should not be misled into thinking that the quantity of prizes available to be won is greater than the actual amount.

Eligibility to win – Advertising should not mislead consumers that they are the only person eligible to win a prize by completing an action.

Previous Winners – Previous winners should be genuine and relate to the PRS service being promoted. Breaches of the PPP Code of Practice have been upheld based on the use of non-genuine testimonials or false previous winners.

Misleading Terms –

The users must not be mislead in anyway

e.g

“Congratulations” (e.g. “Congratulations, you qualified to win….”) should not be used as it incorrectly implies that the reader has already won. Consider replacing with terms such as “It could be your lucky day”

“Selected” (e.g. “You have been selected …) should not be used as it incorrectly implies that the reader has an enhanced chance of winning. Consider replacing with terms such as “You could win …”

“Claim”, “Unclaimed”, “In stock”, “Out of stock”, “Reserve” (e.g. “You may have 1 unclaimed prize” ) should not be used as this misleads the users as to the competition mechanic and implies that the reader has an enhanced chance of winning. Further often these statements are untrue. Further often the intention is to create a false sense of urgency

“Comments”, “Reviews” should not be used unless the comments / reviews are real. If this is an important part of the proposed promotion mechanic, true testimonials can be supplied.

“Just enter your mobile number to qualify” should not be used if the user isn’t asked to enter their MSISDN. Indeed, given that there are a range of mechanics, it is best to not attempt to describe the mechanic in any way.
